2026 Law Update — Data Use and Access Act 2025

The Data Use and Access Act 2025 introduced significant changes to UK cookie law that came into force on 5 February 2026:

New cookie exemptions: Three new categories of cookies are now exempt from the consent requirement under PECR — certain low-risk analytics cookies, cookies used for security and fraud prevention, and cookies used to remember user preferences. These exemptions apply only in narrow, defined circumstances.

Increased penalties: Maximum PECR fines have increased from £500,000 to £17.5 million or 4% of global annual turnover — aligned with UK GDPR. Any contravention of Regulation 6 of PECR can now result in a financial penalty without needing to meet a harm threshold.

justclickstyle.com has reviewed its cookie practices against the DUAA 2025 requirements and this policy reflects those updated obligations.

This policy also reflects ICO guidance updated in 2025, which broadened the scope of PECR from "cookies" to all storage and access technologies, including pixels, web beacons, fingerprinting scripts, and tag-based tracking.
